REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: By-Laws Amendment: Changes for Clarity

Whereas it is the responsibility of the rules committee as per the By-Laws to "review and revise the Council By-Laws, Elections Code, and Judicial Board Procedures" (XI. RULES COMMITTEE - section A-1-a), and

Whereas the By-Laws as they are currently written are difficult, if not impossible, for ordinary to navigate and find information in, and

Whereas the modifications to Robert's Rules of Order should be placed in one place, so they can easily be found in the By-Laws, then

Let it be resolved that Article "V. PARLIAMENTARY PROCEDURE" be modified in the following way, from:

  • A. The Legislative Council shall abide by the parliamentary procedure rules as described in Robert's Rules of Order.
  • B. Use of Robert's Rules of Order is subject to the limitations of the Council by-laws and the ASUCI Constitution

to:

  • A. The Legislative Council shall abide by the parliamentary procedure rules as described in Robert's Rules of Order.
  •        1. Reasonable attempts must be made by the Executive Director of ASUCI and the Chair of Legislative Council to educate members of Legislative Council on the proper use of these rules.
  •        2. Use of said book is subject to the limitations of the Legislative Council By-Laws and the ASUCI Constitution.

Let it be further resolved that Article "IX. LEGISLATION - section K and L" be struck from the By-Laws, and

Let it be further resolved that Article "VII. AGENDA - section D" be struck from the By-Laws, and

Let it be further resolved that Article "III. MEMBERSHIP PROVISIONS - section B - subsection 4" be struck from the By-Laws, and

Let it be further resolved that Article "III-MEMBERSHIP PROVISIONS- section A- subsection 2 - part 2(d)  ("Serves as the voting representative from ASUCI to the University of California  Student Association Board of Directors;") be struck from the By-Laws, and 

Let it be finally resolved that Article "V. PARLIAMENTARY PROCEDURE" shall now include a section B. and C. with the following contents:

  • B. Debates and Reports shall be modified from Robert's Rules of Order in the following ways:
  •     1. All Executive Officer reports and committee reports shall be limited to ten (10) minutes.
  •     2. All debates on bills and resolutions under consideration in Old Business shall be limited to fifteen (15) minutes.
  •     3. All debates on bills and resolutions under consideration in New Business shall be limited to ten (10) minutes.
  •     4. Each member of Legislative Council shall be limited to two (2) minutes speaking time during debate.
  •     5. Each member of Legislative Council may speak only once during debate until all other council members have had the chance to speak.
  •         a) If a member of Legislative Council wishes to speak on a given motion twice, the Chair must first ask if any others wish to speak on the question.
  •        b) The initial reading and introduction of a bill or resolution by its author do not count toward this limit, as it precedes debate.
  •     6. Anyone shall have the opportunity to speak at council meetings, and is to be recognized by the Chair of Legislative Council. Guests shall be empowered to raise points of order and points of information, participate in discussion and propose friendly amendments.
  •     7. If the bill or resolution had been referred to committee, the Chair of that committee shall have the right to be the first to speak in debate.
  • C. Guest Speakers may be invited by any member of Legislative Council to speak at any Regular, Special, or Summer meetings.
  •     1. A guest speaker shall be allotted speaking time on the Agenda and introduced during that time by the Chair of Legislative Council
