REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: ASUCI Code Amendments: Revisions to Council Appointments

Whereas the ASUCI Elections Code, Article 4 Amendments states:

The Rules Committee of the ASUCI Legislative Council shall recommend amendments to this Code to be approved by a 2/3 vote of the ASUCI Legislative Council.

 

Whereas the ASUCI By-Laws, Article 20 Amendment to Council By-Laws, Section B - Amendments and Revisions, Clause 2 states [1]:

 

Amendments to the By-laws shall be proposed and automatically tabled one (1) school week prior to the forthcoming vote by the Legislative Council, to allow for their review. If the amendments are co-authored by the entire Rules Committee, then the bill can be called to vote immediately.

 

Let it be resolved that the Elections Code be amended in the following manner:

 

From ASUCI Elections Code, Article IX. Special Elections:

D. The Legislative Council shall set the date and time for Special Elections.

 

To ASUCI Elections Code, Article IX. Special Elections:

D. In the event more than a third (â…“) of Legislative Council’s seats becomes vacant, a special election shall be called by Legislative Council. All registered undergraduates are eligible to run in the special election as long as they fulfill the qualifications outlined in the ASUCI Constitution, Article 4, Section D.

 

E. The Legislative Council shall set the date and time for Special Elections.

 

Let it further be resolved that the ASUCI By-Laws be amended in the following manner:

 

From ASUCI By-Laws, Article 3 Membership Provisions, Section B, Clause 11:

Vacancies on the Council shall be filled by nomination of the Rules Committee with a two-thirds (2/3) consent of the voting Council members present. All such appointments serve the full term of the vacant seat.

 

Be struck and removed from the By-Laws

 

Add under ASUCI By-Laws, Article 3 Membership Provisions, Section E Vacancies and Appointments:

6. All such appointments made by the Legislative Council shall serve the full term of the vacant seat, unless more than a third (â…“) of Council’s seats are vacant then Council must follow the appointment procedures outlined in ASUCI By-Laws Article 3, Section e, Clause 7

 

7. In the event that more than a third (1/3) of Legislative Council seats become vacant:

  1. The Chair of Council, Council Speaker or Rules Chair must immediately notify Council of the event/occurrence.

  2. All appointments shall serve the term of their appointment up until the ratification of the special election results.

  3. A special election must be called by Legislative Council within a month of the event.

  4. Proper special elections procedure must be followed as outlined in the ASUCI Constitution and Elections Code.
