REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: ASUCI Legislative Council By-Law Amendments

Let it be resolved that the following changes be made to the ASUCI Legislative Council By-Laws

Under Article III. Membership provisions, b. Elected and Appointed Voting Council Member Job Descriptions, the following changes shall be made:

From:
required to staff an ASUCI information table

To:
recommended to staff an ASUCI information table

From:
required to hold office hours at least one hour every week.

To:
recommended to hold office hours at least one hour every week.

Number 3) as read below, shall be removed from the By-Laws:
Council members shall be responsible for providing evidence of completion of these responsibilities to the Executive Vice President. Failure to do so will result in dismissal by the Executive Vice President. Rules Committee

Number 5), 6), and 7) as read below, shall be removed from the By-Laws:
5) Each council member shall introduce and execute at least one legislation per quarter.
6) Council members who fail to complete their appointed duties, as stated, shall be subject to dismissal at the discretion of the ASUCI Executive Vice President Rules Committee.
7) The above Council member responsibilities shall be included with the declaration of candidacy at the time of elections and be given to Council members by the Executive Vice President.

Under Article III. Membership provisions, the following changes shall be made:

c. Dismissal of Legislative Council Representatives

Section c. Appealing Dismissal, renamed in this legislation to Dismissal of Legislative Council Representative, shall read, in its entirety:

1) Elected Legislative Council Representatives may not be removed from office except as stated by the ASUCI Constitution.

2)Appointed Council Members may be removed from office by a legislation passing with (3/4) majority and a majority vote of the Executive Cabinet. Any legislation removing a Council Member from office shall automatically be tabled one week prior to be voting on by Council.

Under Article III. Membership provisions, B. Council Provisions, the following changes shall be made:

From:
Legislation passed by the Legislative Council shall become effective eight (8) days from the date of passage unless otherwise stipulated at the time of passage by a two-thirds vote of the voting Council members present.

To:
Legislation passed by the Legislative Council shall become effective uipon approval of a majority of the Executive Cabinet or after six days have passed.

From:
A regular Council member shall not hold another ASUCI elective office during his/her term on the Council.

To:
A regular Council member shall not hold another paid ASUCI office during his/her term on Council.

Under Article IV. Officers, A. Chairperson and Vice Chairperson, the following changes shall be made:

Number 2., as read below, shall be removed from the By-Laws:
The Vice President of Administrative Affairs Vice President is the Vice Chairperson of the Legislative Council and shall serve as Chair if the Executive Vice President is unable to do so.

Number 2. shall be changed to the following:
Any parliamentary procedure decision by the Chair of Legislative Council may be appealed to the Chair by any member of Council. The Chair may either affirm or rescind his decision. Should the Chair affirm his decision, any Council Member may call a vote to overturn the Chair by a majority vote of Council.

Number 3. shall be changed from:
In the absence of the Administrative Affairs Vice President, the Academic Affairs Vice President, the Chair of the Rules committee, and then the Vice Chair of the Rules committee shall serve as Chair in that order.

To:
In the absence of the Executive Vice President, the Chairperson of the Legislative Council will result to the Chair of the Rules Committee, and then Vice Chair of the Rules Committee. Should no officer as stated in section IV be able to chair Legislative Council, the Legislative Council shall appoint a voting Council member by a majority vote as chair for that session.

Under Article IV. Meetings. the following changes shall be made:

G. Attendance shall be stricken in its entirety from the By-Laws. This includes the numbers 1 through 6 under it.

Under Article IV. Meetings, D. Summer Meetings, the following changes shall be made:

From:
a minimum of (3) Executive Officers must be present to conduct business.

To:
a minimum of (2) Executive Officers must be present to conduct business.

Under Article IX. Legislation, the following changes shall be made:

From:
in order to be on the agenda for the following Tuesday Council Session.

To:
in order to be placed on the agenda by the Council Secretary for the following Tuesday Council Session.

From:
All bills and/or resolutions shall be posted in the ASUCI lobby at least three (3) days prior to their introduction to Legislative Council. This provision may be suspended by a two-thirds (2/3) vote of the Legislative Council.

To:
All bills and/or resolutions that have not been submitted to the Executive Vice President in time to be placed on the agenda as outlined in part C may be added during the approval of the agenda by a majority vote of Council.

From:
The final vote and passage of legislation shall be confirmed by signature of the legislation by the chair of legislative council, and the chairs of the standing committees to which the legislation was referred, and shall be subsequently submitted to the ASUCI Judicial Board for its consideration by 5:00PM on the day following the legislations passage.

To:
The final vote and passage of legislation shall be confirmed by signature of the legislation by the chair of legislative council, and the chairs of the committees to which the legislation was referred, and shall be subsequently submitted to the ASUCI Judicial Board for its consideration within 48 hours of its passage.

Under Article X. Committees, the following changes shall be made:

From:
Each Council member shall serve on a Committee.

To:
Each Council member shall serve on one standing Committee.

From:
All committees shall select a Chair and vice chair by a majority vote of members including the Executive Officers. No Chair or Vice Chair shall be an Executive Officer.

To:
The Chair, vice Chair, and general membership of each committee shall be selected by a legislation passing with a majority vote of Council.

Under Article XV. Guidelines for the Expenditure of ASUCI Funds, the following changes shall be made:

From:
current academic year and the Executive Officers of the upcoming year and passed by the Legislative Council of the current academic year.

To:
current academic year, the Executive Officers of the upcoming year, and the current Chair of Rules, Finance, and Public Information and passed by the Legislative Council of the current academic year.

Let it be resolved that where numbers or sections have been removed, the number or letter of other numbers or sections near the removed section be changed to remove gaps in lettering or numbering.

Let it be resolved that ASUCI update the By-Laws on the ASUCI web page to reflect these changes as soon as possible.
