REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: ASUCI Constitution Article VI ASUCI Judicial Board Amendment

Let it be resolved that the following changes shall be made to the ASUCI Constitution under Article VI ASUCI Judicial Board:

Under Section A, the following shall be added as a separate clause:

 

Cases to be heard by the Judicial Board must arise in one of the following manners:

 

              1. To appeal a ruling by the elections commissioner;

   

              2. To appeal a ruling by the Student Programming Funding Board;

3. Or, any claim from a registered student who can prove standing (injury) for a case. Where injury refers generally to loss suffered by either an individual or a group,

 

Under Section B, the following shall be added:

For a ruling to become effective, all appointed Judicial Board members must be present to vote.

 

So that it reads as follows:

 

The rulings of the Judicial Board shall be enacted upon a majority vote of all seven (7) Judicial Board members. For a ruling to become effective, all appointed Judicial Board members must be present to vote. The authority of the Judicial Board shall include, but is not limited to:

 

Under Section B, Subsection 4, the following shall be added:

 

Charges must arise in accordance with Article VI, Section A;

 

So that it reads as follows:

 4. Investigating charges of violations of this Constitution, the By-laws, and all other rules and regulations of ASUCI. Charges must arise in accordance with Article VI, Section A;

Under Section C, Subsection 11, the following shall be added:

 

            Meetings shall be held each Wednesday after 5:00 PM.

 

So that it reads as follows:

11. A Judicial Board member shall attend weekly meetings to review all pending legislation and other business. Meetings shall be held each Wednesday after 5:00 PM. Any Judicial Board member absent from three (3) weekly meetings per quarter shall be subject to the automatic forfeiture of the office. An appeal may be made to the Legislation Council, which may exercise the right to reinstate a Judicial Board member upon a two-thirds (2/3) affirmative vote of the voting members present.

Under Section D, Subsection 1a Judicial Board Chair, the following shall be changed:

 

From:

a. Chairs and organizes Judicial Board meetings.

 

To:

a. Chairs, conducts accurate attendance of the members present, and organizes the Judicial Board meetings to be held each Wednesday after 5:00PM.

 

Let it be resolved that as stated by the ASUCI Constitution, Article X Constitutional Amendments, Section A, "upon approval of a two-thirds (2/3) majority vote of the voting members of the Legislative Council… the Legislative Council shall submit said amendment to a vote of the undergraduate students."

 

Let it be resolved that as stated by ASUCI Constitution, Article X Constitutional Amendments, Section B, "The Legislative Council shall arrange for proper publicity, which shall include, but it is not limited to, the publications and broadcast of the full text of the amendment in the various student media during the week prior to election. Full texts shall also be made available at the polls and at the other regular distribution locations."

 

Let it be resolved that upon a two-thirds (2/3) vote of at least twenty percent (20%) of the Associated Students voting and upon the approval of the Chancellor, the changes shall be made to the ASUCI Constitution to reflect the adoption of this amendment.
