REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: Elections Code Revisions

Whereas, the ASUCI Spring Elections of recent memory have been marred by the disqualification of candidates by the Judical Board due to the interpretation of rules established in the Elections Code by the Legislative Council, and

Whereas those rules are subject to modification and amendment by the Legislative Council by a vote of 2/3 of the members present, and

Whereas the Legislative Council and the Office of the Executive Vice President has a vested interest in ensuring the fairness and equity of the elections process to all candidates,

Let it be resolved that the following amendments be made to the ASUCI Elections Code in the hope that fewer electoral complaints will necessitate appeal to the Judicial Board:

Under Article XI, Section C (sub 6) the line "Conduct a Mandatory Orientation meeting for all candidates..." will be changed to "Conduct an orientation meeting for all the candidates."

Under Article XVII, Section C (subsections 1 and 2) the word "detailed" will be removed to read "A list of all campaign expenditures..."  & "A list of all donated money..." respectively.

Under Article XVII, a new Section F will be added to read "The intent of the Financial Statement is to allow for the fairness and transparency of ASUCI elections rather than to asses the direct financial activities of individuals running for office.  The financial statement does not function as an accounting spreadsheet to which meticulous scrutiny shall be paid, but rather as a document declaring donations and fiscal decisions made by a candidate so that the fairness and integrity of ASUCI can be maintained."

Under Article XXI, Section A will be changed to read "The only violations which shall result in a candidate being disqualifed from office are as follows:" 

Under Article XXI, Section A, a subsection 6 will be added that will read as follows:  "6. Falsification within the meaning of this document shall be restricted to fradulent claims stated with the deliberate attempt to circumvent the spirit of the ASUCI Elections Code, and shall not apply to any monetary declaration on the financial statement valuing less than $100 or one which constitutes less than 15% of the candidates campaign."
