REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: The Student Voice Amendment

It is the purpose of any governing document to elucidate the path of its constituents. The intent of a constituency shall be made clear through its governing documents.

 

Whereas, the purpose of the Associated Undergraduate Students of the University California Irvine is to, by the best measure possible, preserve, protect, maintain, and sustain the democratic ideal instilled within the student population by the United States of America’s and California’s respective Constitution(s),

 

Whereas, it is the express purpose and intent of student government to harbor these noble ideals,

 

Whereas, it is the responsibility of an elected representative to speak on behalf of their constituents,

 

Whereas, it would be inappropriate if student government were not given the tools necessary to appropriate and maintain a conductive dynamic between the pressing concerns of past, present, and future students,

 

Whereas, it has been deemed that Article X of the Constitution does not represent a viable articulation of the student will and in fact represents an antiquated archetype of which does not represent the current or foreseeable future will of its’ students,

 

Whereas, it is the responsibility and duty of  student government to suggest such changes so as to serve as the catalyst for change within the student body in an effort to preserve the will of the undergraduate student(s),

 

Whereas, Article IV Section A of the Constitution vests such power into Legislative Council, and by delineation the voting members of Legislative Council,

 

Whereas, the voting members of Legislative Council speak on behalf of the undergraduate student body, as members duly elected by their peers, they not only act in the best interests of the student body, but also act in concurrence with their will,

 

Therefore, let it be resolved that the “Student Voice Amendment,” as provided below, be presented to a vote by the undergraduate students at large, as stipulated per Article X of the Constitution, in an effort by Legislative Council and a concerned student body to maintain a more perfect union between the temporal nature of life and the incorrigible democratic ideal of which stipulates by natural law the right of all people to life, liberty, and the pursuit of happiness.

 

Furthermore, let it be resolved that if said amendment garners a two thirds (2/3) vote, with at least twenty percent (20%) of the Associated Students voting and gains the approval of the Chancellor, that its effects become immediate.

 

 

The Student Voice Amendment

ARTICLE X

CONSTITUTIONAL AMENDMENTS

Section A

Amendments to this Constitution may be made by either of the following two (2) methods:

1. Upon approval of a two-thirds (2/3) majority vote of the voting members of the Legislative Council.

2. Upon presentation of a petition, signed by ten percent (10%) of the undergraduate students to the Legislative Council.

Upon fulfillment of either (a) or (b) above, the Legislative Council shall submit said amendment to a vote of the undergraduate students. Regular election procedures shall be followed as prescribed by the Elections Code and the last paragraph of Article VIII of this Constitution.

Section B

The Legislative Council shall arrange for proper publicity of the election, which shall include, but is not limited to, the publications and broadcast of the full text of the amendment in the various student media during the school week prior to the election. Full texts shall also be made available at the polls and at the other regular distribution locations.

Section C

A two-thirds (2/3) vote, with at least twenty percent (20%) of the Associated Students voting and the approval of the Chancellor, shall be required for the adoption of the amendment(s).

ARTICLE X

CONSTITUTIONAL AMENDMENTS

Section A

Amendments to this Constitution may be made by either of the following two (2) methods:

1. By a four-fifths (4/5) majority vote of all the voting members of the Legislative Council

OR

2. By Popular Election

a. Adoption of an Amendment by Popular Election requires that a petition signed by ten percent (10%) of the undergraduate students be presented to Legislative Council.

b. Upon presentation of said Petition the Legislative Council shall submit said amendment to a vote of the undergraduate students. Regular election procedures shall be followed as prescribed by the Elections Code and the    last paragraph of Article VIII of this Constitution. 

c. The Legislative Council shall arrange for proper publicity of the election, which shall include, but is not limited to, the publications and broadcast of the full text of the amendment in the various student media during the school week prior to the election. Full texts shall also be made available at regular distribution locations.

d. A two-thirds (2/3) vote, with at least twenty percent (20%) of the Associated Students voting shall be required for the adoption of the amendment(s).

 

Section B

All Amendments to this Constitution require ratification from the Vice-Chancellor of Student Affairs in order to take effect. The effects of this ratification are immediate.

Section C

Amendments to this Constitution shall be proposed and automatically tabled one (1) school week prior to the vote by the Legislative Council, to allow for their review.
