REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: Elections Code Reform: Registered Slates

Whereas, the ASUCI Elections Code governs how elections are implemented and take place for elected positions to ASUCI,

Whereas, the ASUCI Elections Code is in need of serious reform in order to ensure that the democratic process and voter capability stays strong, 

Whereas, slating is an often implemented method for candidates to combine funds, ideas, and campaigning practices, 

Whereas, slates create greater ability for candidates to mobilize and reach out to the student body in order to empower them to vote, thus perpetuating a democratic and election sprit on campus,

Whereas, slates are ,in the status quo, a confederation of candidates who have unofficially signed on together to pool resources in order to enhance their odds of electability and are individuals who share the same ideas about office,

Whereas, currently the Elections Code only empowers the the ASUCI Elections Commission and its members to only regulate candidates at the individual level and cannot regulate slate actions as a whole,

Whereas, candidates should have the right to decide as to how they ant to be represented on the ballot and if that should mirror their efforts through campaigning with a slate,

Whereas, voters have a right to be able to to make educated decisions on the electoral process when voting based on the information being put out by slates, 

Whereas, the information being put out by slates should be regulated to ensure their validity and protect voter's rights, 

Whereas, currently there is no option for members of a slate to officially register that slate with the ASUCI Elections Commission,

Whereas, the goal of a ballot is to ensure that a voter has ease and time-sensitive valid information to make an educated vote,

Therefore Let it Be Resolved that an amendment be made to the ASUCI Elections Code creating the new Article " Article XVI: Registered Slates" following Article XV "Candidate Responsibilities"(thus shifting the existing Articles after the newly created article by one) permitting the option to candidates to register their slate and chosen name for the slate, excluding language that has profanity, is discriminatory, or usurps authority from an unknowing party. The registration of a Slate with the ASUCI Elections Commission shall be completely optional to the candidates of said slate and if chosen not to register their slate, their slate shall remain unofficial. 

Let it further be resolved, that slates that do register with the ASUCI Elections Commission shall appear on the ballot as a slate and as individuals. Giving the voter an option to select to vote for the slate as a ticket or being able to vote with the current method of voting individually by candidate to the office they are running for. Candidates choosing to register their slate with the ASUCI Elections commission shall also face official regulation by the ASUCI Elections commission, requiring them to file not only individual endorsement forms and financial donations they may receive but also must register as a slate the combined endorsements and financial donations they may receive. Slates may have a combination of ASUCI Legislative Council Candidates and Executive Candidates on them. The registered slates shall appear above Executive Officer Seats and below Recall Elections for ballot order. 

Let it further be resolved, that the proper form or paperwork shall be delegated to the Elections Commissioner to be created and this shall fall under their position as a new responsibility of the Elections Commissioner to handle prior to elections. This change shall be reflected in Article XI Elections Commissioner, Section C, Sub-Section 8, Paragraph i.  

Let it further be resolved, that slates that do choose to register shall also be eligible to receive disputes filed  holistically against them, shall pertain to every candidate on that slate, to any matter that may have benefitted the whole slate that is in violation of the ASUCI Elections Code. Thus making all parties within the registered slate culpable and liable if they are to be found guilty by the ruling authority on the matter (Elections Commission or Judicial Board). 

Let it further be resolved that the change to the ASUCI Elections Code shall appear exactly as shown below in bold:

Article XVI. Registered Slates 

A. A given slate or ticket created by candidates shall be permitted to register with the ASUCI Elections Commission by filing proper paperwork provided by the ASUCI Elections Commission and the ASUCI Elections Commissioner. Any name for a slate shall be accepted excluding ones that use language that has profanity, is discriminatory, or usurps authority from an unknowing party. This option of registration shall be fully optional to the select candidates and the unofficial slate and shall not be coerced or pressed by ASUCI Elections Commission or any other branch of ASUCI to register. 

B. If a slate chooses to register and becomes an Official Slate regulated by the Election Commission it shall gain and adhere to the following standards:

1. The newly registered Official Slate shall have its name appear on the Ballot with all members of its slate listed under it giving the option to voters to select the entire slate and to cast a ballot in favor for all members on said slate. If a voter chooses to do so they will not be able to vote for those said races again in order to avoid a dual vote and will only be able to vote for the remaining options they have available that did not have candidates in the slate. Candidates names shall still appear individually for voters to elect them individually if a voter chooses to only vote for select members of a slate and not the others.  

2. Newly registered Official Slates shall face regulation as a slate as a whole in addition to already individual regulation of candidates by the ASUCI Elections Commission. This will require the newly registered Slate to turn in a Financial Statement of funds that the slate as a wholes used or funds that was spent by a candidate under the slate that benefited the entire slate. The same requirement stated in the previous statement shall apply to Endorsement Forms; Any endorsement made for the slate as a whole shall require an Endorsement Form for the whole slate be submitted and any endorsement that is made for an individual candidate though is advertised in such a way to give off the impression of endorsing the entire slate shall also require an Endorsement Form to be submitted for the whole slate. Failure to turn in the proper paperwork will hold the entire slate responsible. Their will be a designated slate representative, chosen by the slate--they do not have to be a candidate on the slate, that will sign off on all Endorsement Forms and on the Financial Statement. 

3. Officially registered slates will have the permission to have an array of Executive Board candidates and Legislative Council candidates or have selective slates of only candidates for Executive Board or only for ASUCI Legislative Council. 

C. The placement of officially registered slates on the Ballot shall be placed above Executive Officer Seats and below Recall Elections (if any) or below whatever race takes precedent over Recall Elections. If multiple slates are registered they will be put at a random order amongst each other as decided by the authority that creates the ballot. The names of the individual candidates shall also appear under the respective seats they are running for as well in order to give the voter freedom to vote for specific members of the slate if they choose not to support the slate as a whole. 

D. The paperwork created by for this regulation shall be titled "Official Slate Registration Form". It shall be created by the Elections Commissioner and include the terms that the said Slate would agree to if they choose to file as an Officially Registered Slate. The format and creation of the form shall be delegated to the Election Commissioner's discretion, however it must include the terms (as outlined in this Article) that the candidates are agreeing upon, a portion for all the candidates in slate to sign to show their consent of terms, and a section to designate who the Slate Representative will be and their contact information. The Election Commissioner will forward any matters the ASUCI Elections Commission has regarding the slate to the Slate Representative.   

E. The timeline to officially register a slate shall only be one week from the start date of permissible campaigning. It shall be prohibited to register anytime previous to this timeframe or after. Endorsements or finances received prior to the date of registration, that have affected the whole slate, will not be grandfathered and will still require the newly official slate to turn in proper Endorsement Forms and Financial Forms. Endorsement Forms for these circumstances stated previously will be given a two day grace period to allow for the slate to turn in their Endorsement Form under the new regulations since they may have already been advertising them previous to becoming an official slate. 

XI. ELECTIONS COMMISSIONER 

A. The ASUCI Executive Vice-President shall appoint an Elections Commissioner in accordance with the ASUCI Constitution. 

B. Once appointed, this person waives their Constitutional right to file a declaration of candidacy until the beginning of the next academic year. 

C. The Elections Commissioner's duties and responsibilities shall be as follows: 

1. Facilitate and supervise all ASUCI Elections. 

2. Post and hold regular office hours in the ASUCI offices as soon as applications for candidacy are available and until the Elections Ratification has been concluded. 

3. In conjunction with the Executive Vice-President, recommend the appointment of three Deputy Elections Commissioners to the ASUCI Legislative Council. 

4. Hold Evidentiary Hearings as part of the Elections Commission to review official ASUCI Complaints, as well as any official complaints submitted by students or candidates. All decisions on official complaint(s) shall be in writing and posted on the bulletin board outside the ASUCI offices as soon as the Elections Commission reaches a decision. 

5. Attend any formal ASUCI Legislative Council meeting during the Elections process if requested by the ASUCI Legislative Council or an Executive Officer. 

6. Conduct a Mandatory Orientation meeting for all candidates or their representatives at which time the Elections Code, the University policy, and UCI Principles of Community shall be reviewed and the rules and candidate deadlines explained. 

7. Review disqualifications before the ASUCI Judicial Board. 

8. Create updated Elections Packet, to be available online and its mandatory components submittable by candidates online, excluding the Financial Statement with attached receipts and all Endorsement Forms, which must be physically turned in by candidate 

i. The Elections Packet should include: 

Cover Letter, Elections Timeline, Declaration of Candidacy, Candidates Statement form, GPA Verification Consent form, University Policy and Principles of Community Consent form, Financial Statement, Endorsement Form, Official Slate Registration Form, and ASUCI Elections Code.  

9. The Elections Commissioner shall be present at all Judicial Board hearings that are concerned with candidate(s) and/or the Elections process. 

10. Instruct the deputy Elections Commissioners on their duties and responsibilities, ensuring that each Deputy Commissioner has full knowledge of the Election Code. 

D. The Executive Vice-President and the Executive Director and the Legislative Council may adjust the compensation of the Elections Commissioner to an amount commensurate with the adequacy of his/her performance if the Elections Commissioner does not meet his/her duties as specified in this section of the Elections Code. 

E. Should the Executive Vice-President file a Declaration of Candidacy, the Elections Commission shall be temporarily assigned to an Executive Officer who has not filed a Declaration of Candidacy. The assigned Executive Officer shall incur the duty of the Executive Vice-President as they relate to the elections in accordance with the ASUCI Constitution. 

F. In the event that all Executive Officers file a Declaration of Candidacy, the ASUCI Legislative Council shall appoint a new chair for the Elections Commission from within voting council members who have not filed a Declaration of Candidacy with a two-thirds vote of eligible voting council members present.
