All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full. |

| Whereas, ASUCI Elections are meant to represent the ideas and concerns of student on the UC Irvine campus, Whereas, ASUCI candidates for office should represent ideas relevant to the students of UC Irvine, matters relating to UC Irvine, and relating to the general welfare of students at UC Irvine, Whereas, the integrity of information given to students is contingent upon the information that is being advertised by candidates to students or by organizations that support candidates to students, Whereas, the ASUCI Elections Code is intended to protect candidate's rights, voter's rights, and the integrity of a fair and democratic election, Whereas, endorsements by organizations both registered within Dean of Students and not registered under Dean of Students is interpreted as permissible under the current ASUCI Elections Code as per Judicial Board Ruling Khorsandi v. Elections Commission, Whereas, the ASUCI Elections Code has a grey area as to what organizations are permissible to endorse candidates and what organizations are not permissible to endorse candidates, Whereas, the ASUCI Elections Commission has made an appeal to the ASUCI Legislative Council to enact legislation to fix this grey area and to exclusively deny outside organizations from being able to endorse candidates and within the Majority Opinion of the Judicial Board Decision of Khorsandi v. Elections Commission it states "If ASUCI does not amend all three elections codes disclosed in the three violations presented by Khorsandi, there are detrimental consequences to the integrity of ASUCI and its political process." Whereas, the ASUCI Elections Code clearly states that it is permissible to be endorsed by registered organizations under Dean of Students (DOS), also known as Office of Student Life and Leadership, Whereas, organizations registered under Dean of Students are organizations that have gone through a process of registration and proof that they are valuable organizations to student life on campus and relevant organizations that represent student values of UC Irvine, Whereas, Dean of Student registered organizations are all organizations that are designed for the growth of UC Irvine community, are non-profit, and are not groups like corporations or outside organizations that have no relevance to UC Irvine or specific Irvine values and are all student ran, Whereas, there are over 500 registered organization under Dean of Students which means a cornucopia of values are represented, interests, and values on campus, thus allowing candidates to have a wide array of potential endorsements that could match their values, Whereas, outside organizations have no exclusive interests in UC Irvine, may have other commitments besides UC Irvine, and are not the best form of an endorsement for Candidates because they may have values of conflict of interest vested in a candidates election to office, Whereas, endorsements for candidates should be limited to UC Irvine Organization that are registered under Dean of Students to ensure student values are being represented and not unaffiliated non-UC Irvine values are being represented, Let it Be Resolved that the ASUCI Elections Code be reformed to exclusively deny outside non-registered Dean of Students organizations from formally endorsing a candidate for any office in ASUCI elections. Let it further be resolved that the ASUCI Elections code prohibit candidate cooperation with any outside organization not registered with Dean of Students that would give said candidate the resources, aid, and advantage in an ASUCI Election or create a display of an unofficial endorsement by an outside organization that is advertised to students, Let it further be resolved that the only permissible endorsements, that follow proper procedure, shall be ones that are endorsements from registered organization under Dean Of Students, Let it further be resolved that the following changes to the ASUCI Elections Code shall appear exactly as shown below in bold to Article XV. Candidate Responsibilities Section G and creating a new Section "H" XV. CANDIDATE RESPONSIBILITIES A. All candidates must file a declaration of candidacy in accordance with the elections timeline. B. All candidates must adhere to the ASUCI Code of Ethics. C. All candidates are required to attend the mandatory orientation meeting conducted by the Elections Commissioner at which time the Elections Code and campaigning rules shall be fully reviewed. Under extenuating circumstances that have been discussed with the Elections Commissioner in which the candidate cannot attend the scheduled Candidates Meeting, a private meeting may be scheduled for the candidate. D. All candidates shall be responsible for meeting all deadlines of the Elections Timeline and the deadline to turn in a financial statement. E. All candidates shall check the sample ballot, created by the Elections Commission, for misspellings or errors. Any corrections shall be presented to a member of the Elections Commission in writing at least five (5) school days prior to the first day of balloting. F. All candidates shall familiarize themselves with this Elections Code. G. Any candidate can be endorsed by an organization registered with the Dean of Students and must submit the Candidate Endorsement Form signed by the leading student officer(s) of the organization, stating that the organization (not the individual) has officially endorsed him/her. Only endorsements from a registered organization under Dean of Students shall be permissible. All other endorsements received from outside organization not registered under Dean Of Students shall not be accepted by the ASUCI Elections Commission and can not be used by candidates. No campaign material may be distributed until the Deputy Elections Commissioner for Compliance has acknowledged receipt of the endorsement. H. Candidates may not coordinate with outside organization to further their campaign or to receive aid for their campaign to achieve elected office. Candidates may not coordinate with outside organizations regardless of an official endorsement received by them, which are invalid due to Section G. Such collaboration by the candidates with an outside organization that leads to an advantage to that candidates campaign, aid to that campaign, or any the of advert that would further that campaign's goal of elected office shall be strictly prohibited and if violated face action from Elections Commission or higher authority. |
