REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: Election Code Reform

Whereas ‘Section X. Positing of Results’ within the elections code necessitates changes,
Whereas written the Elections Code refers to NACS, a campus computing service previously used to tabulate votes for ASUCI Elections.

Whereas the there were inflexibility of the service and high costs associated with the system.
Whereas the tabulation of results is done ‘in-house’ by Student Government and Student Media Professional staff.
Let it be resolved that the elections code should be changed as follows.
Current Language:
Section X. Positing of Results
As written the Elections Code refers to NACS, a campus computing service previously used to tabulate votes for ASUCI Elections, due to inflexibility of the service and high costs associate with the service tabulation of results is done ‘in-house’ by Student Government and Student Media Professional staff.
“B. The Network and Academic Computing Services (NACS) will tabulate the results. The results shall be electronically mailed as a spreadsheet attachment to the ASUCI Executive Director and the Elections Commissioner, except for those offices where an official complaint has been filed.”
Proposal:
“B. Student Government and Student Media Technology Services will tabulate the results. The results shall be electronically mailed as a spreadsheet attachment to the Student Government and Student Media Executive Director and the Elections Commissioner, except for those offices where an official complaint has been filed.”

Section XII. Deputy Elections Commissioners
Whereas ‘Section XII. Deputy Commissioners’ within the elections code necessitates changes on the basis of Gaspar v. Siddiqui ,
Whereas the Currently the Elections code holds the Deputy Commissioner for Compliance to verify the eligibility of candidates in respect to the Elections Code.
Whereas candidates do waive some rights to privacy in the ‘elections packet,’ there are still significant concerns in regards to federal student privacy rights and university policy.
Let it be resolved that the elections code should be changed as follows.
Current:
“C.  The duties of the three Deputy Elections Commissioners shall be as follows:
1. The Deputy Elections Commissioner for Compliance shall be responsible for verifying the eligibility of each candidate with the Registrar’s office, the Academic Counseling Office of the Candidate’s School(s), and the Judicial Affairs Office.”
Change:
“C.  The duties of the three Deputy Elections Commissioners shall be as follows:
1. The Deputy Elections Commissioner for Compliance shall be responsible for verifying the eligibility of each candidate with the Executive Director of Student Government and Student Media who references the Registrar’s office, the Academic Counseling Office of the Candidate’s School(s), and the Judicial Affairs Office.”
Whereas ‘Section XX. Campaigning and Publicity’ within the elections code necessitates change on the basis of (Khorsandi’s Case)
Whereas the use of and misappropriation of ASUCI Property has been a perpetual issue with ASUCI Elections.
Whereas the current language is vague and inadequately reflects the current state of technology and media.
Whereas this proposal expands and clarifies the clause and defines the role of staff as ‘property.’
Let it be resolved that the elections code should be changed as follows.
Current:
“G.  The use of ASUCI and/or University equipment, and/or telephones (except in a manner available to the entire student population) for campaigning is prohibited.”
Change:
“G. The use of ASUCI and/or University equipment purchased or funded by student funds allocated to ASUCI eg.(telephones, computers, printers, paper, copies, fax, scanners, cameras, projectors, tables, chairs, canopies) or any other property not available to the entire student population for campaigning is prohibited.
1. Student Government and Student Media staff shall not be defined as ASUCI and/or University equipment and may be used as a resource to all candidates, with all standard fees for services requested.”

F. No advertising Materials of a candidate (flyers, t-shirts, buttons, etc.) shall be allowed into any ASUCI working space. Including but not limited to the ASUCI student suite, the Student Government and Student Media business offices, and professional offices.


Let it finally be resolved that these changes will be effective as of Spring 2013 Elections
