REQUEST FOR ACTION BY THE LEGISLATIVE COUNCIL 
 
All requests may be typed and submitted to the Executive Vice President no later 5:00 p.m. Thursday in order to be included in the agenda for the following Tuesday. The Executive Vice President reserves the right to delay the Request for Action to a later Council session if the Executive Vice President feels the agenda for the next schedule meeting is full.

Synopsis: By-Law Amendment Commissioner Audits and Approval

Whereas, ASUCI is a governing body for the collective students of the University of California Irvine and aims to represent students in the most effective way possible,

 

Whereas, ASUCI acts as an avenue for students to become engaged with their student government and work to become student leaders,

 

Whereas, ASUCI and its officials should be held at a high threshold of accountability in order to ensure a conflict of interest is not occurring and a dependable shared governance,

 

Whereas, the executive powers of the executive cabinet must be checked in order to ensure a democratic process is held through for the appointment of commissioners and there appointment is based of merit, 

 

Whereas, it is the duty of ASUCI Legislative Council to properly take oversight of those appointments of Commissioners as stipulated in the ASUCI By-Laws under each responsibility of an Executive Officer requiring a majority vote of Council, though does not stipulate a process for conducting such an approval,

 

Whereas, ASUCI Legislative Council shall require a method to properly carry out such audits to ensure that executive offices are being held accountable for their appointments,

 

Whereas, the goals for these shall aim to create more transparency in the selection process of Commissioners and to ensure that these members are appointed effectively and with due diligence,

 

Whereas, appointment methods and oversight shall follow proper ASUCI hiring policies and meet ASUCI Ethics Codes

 

Let is Be Resolved that a By-Law Amendment be made that to the ASUCI By-Laws under Section III Membership and Sub-Section B. Council Provisions Creating a new sub-point 8

 

Let it Further Be Resolved that all newly elected Executive Cabinet members be required to submit all their Chiefs of Staffs (or equivalent of) to a hearing with ASUCI Legislative Council where they shall be questioned and audited for their selection, this shall happen no later than Week 10 of Spring Quarter. 

 

Let it Further Be Resolved that that Rules Committee is given a full Roster of all Commissioners selected to be in each respective Executive Cabinet members office regardless of if they are receiving pay or not and the Rules Committee shall select Commissioners to be submitted to Council for an audit and approval. 

 

Let all changes to the By-Laws be Reflected in bold Below:

 

8. All Executive Cabinet members who are newly elected shall send their Chiefs of Staff, or equivalent of, to ASUCI Legislative Council to be reviewed and questioned by members of the council in a hearing to be approved for their appointment. They shall be sent and hearings completed no later than Week 10 of Spring Quarter of the year those Executives are elected. Then upon the selection of all commissioners or directors in each respective office, each newly elected Executive shall submit a roster with job description of all paid and non-paid commissioners to the Speaker Pro Tempore of ASUCI Legislative Council or Chair of Rules Committee and then the Rules Committee will review which commissioners require a council audit and approval, and complete that process of selection and conducting of hearings by the Thursday of Week 3 of fall quarter. All legislation for the approval of non-selected members of an office may be submitted before or after the audit/approval of members have been reviewed.
